Happy Santa Holiday Lights & Party Rentals Terms of Service

Welcome to Happy Santa Holiday Lights & Party Rentals. By booking, approving a quote, or using our services, you agree to the following terms of service. Please read them carefully.

1. Acceptance of Terms

By using our services, you agree to be bound by these Terms of Service. If you do not agree, please do not proceed with booking or installation.

2. Description of Services

Happy Santa provides professional services including, but not limited to:

  • Holiday light installation, maintenance, and removal

  • Rental of holiday lighting, décor, and accessories

  • Event and party rentals such as tents, tables, chairs, lighting, and related equipment

All lighting, décor, and rental equipment provided by Happy Santa remain rental property and are not sold unless explicitly stated in writing.

3. Privacy & Data Collection

We respect your privacy. We collect basic contact information (name, phone number, email, address) solely for internal business communication and service fulfillment.
We do not sell or share client data with third parties without consent.

4. Service Limitations

Our services may be affected by factors outside our control, including but not limited to:

  • Weather conditions

  • Property access issues

  • HOA restrictions

  • Product availability

  • Unforeseen site conditions

We reserve the right to adjust schedules or services as needed and will communicate any changes promptly.

5. Pricing & Payments

Pricing for all services is provided via written quote or invoice and must be approved prior to scheduling.

Deposits

  • A non-refundable deposit of 50% is required to secure any installation or rental date.

  • Deposits reserve labor, equipment, and scheduling and are non-refundable for any reason.

Final Payment Timing

  • Holiday Lighting Services:
    The remaining balance is due immediately upon completion of installation, unless otherwise stated in writing.

  • Party Rental Services:
    The remaining balance is due no later than 10 days prior to the scheduled event date, unless otherwise stated in writing.

Late Payments (Holiday Lighting Only)

  • A 7-day grace period is provided following completion of holiday light installation.

  • After the grace period:

    • A $35 late fee will be applied

    • Plus $10 per week until the balance is paid in full

Non-Payment

All lighting, décor, and rental equipment remain the property of Happy Santa.

If payment is not received after the applicable grace period, Happy Santa reserves the right to disable, remove, or retrieve rental equipment without notice. Removal for non-payment does not cancel the outstanding balance. Any reinstallation will require full payment plus applicable reinstallation fees.

Additional charges may apply for custom requests or changes made after approval.

  • Pricing is provided via written quote or invoice.

  • The remaining balance is due immediately upon completion of installation for holiday lighting or 10 days prior to event for party rentals unless otherwise stated in writing.

6. Cancellations & Refunds

  • Cancellations terms vary by service type and are outlined below.

  • All deposits are non-refundable, regardless of cancellation timing.

  • Holiday Lighting Service- if installation has begun or been completed the full balance remains due, as materials, labor, and scheduling resources have already been allocated.

  • Party Rental Services - Final payment is due no latter than (10) days prior to scheduled event date, unless otherwise stated in writing. Once final payment is received,, all payments for party rentals services are non-refundable, regardless of cancellation timing, event changes, or reductions in rented items.

If Happy Santa must cancel or reschedule due to weather, safety concerns or unforeseen circumstances, we will notify you promptly and make every effort to reschedule the service or rental date. 

7. Damage, Loss & Cleaning Fees

All equipment, décor, tents, tables, chairs, lighting, and accessories provided by Happy Santa are rental items and remain the sole property of Happy Santa at all times.

The client assumes full responsibility for all rented items from the time of delivery or installation until pickup or removal. Any items that are lost, stolen, damaged, excessively dirty, or returned incomplete may result in additional charges.

Additional charges may include, but are not limited to:

  • Repair or replacement costs for damaged or missing equipment

  • Cleaning fees for items returned with excessive dirt, wax, food residue, stains, or debris

  • Labor charges for excessive cleanup or restoration

Costs will be assessed at replacement value where applicable and charged to the payment method on file or invoiced to the client.

8. Access, Utilities & Site Conditions

The client is responsible for providing safe, clear, and unobstructed access to the installation or event location at the scheduled delivery, installation, and pickup times.

The client must also ensure:

  • Adequate space for delivery vehicles and installation crews

  • A safe and level surface for equipment placement

  • Access to required electrical power where applicable

Happy Santa is not responsible for delays or inability to complete services due to restricted access, locked gates, HOA restrictions, unsafe site conditions, pets, or unavailable power sources. Additional labor or return trip fees may apply if access is not available as scheduled.

9. Weather, Wind & Tent Safety

For party rental services involving tents, canopies, lighting, or outdoor equipment, client safety is the top priority.

Happy Santa reserves the right to delay, modify, secure, or remove equipment if weather conditions — including high winds, storms, or unsafe ground conditions — pose a safety risk to people or property.

If tents or equipment must be removed or adjusted due to unsafe conditions:

  • This does not qualify for a refund

  • Happy Santa is not responsible for event disruption caused by weather-related safety decisions

The client agrees not to alter, move, weigh down, or modify any tent or equipment once installed. Any unauthorized adjustments release Happy Santa from liability for resulting damage or injury.

10. Intellectual Property

All content, designs, images, and materials created or provided by Happy Santa remain our intellectual property and may not be copied, reproduced, or distributed without written permission.

11. Liability Limitations

Happy Santa is not responsible for:

  • Pre-existing damage

  • Normal wear and tear

  • Issues related to electrical systems not installed by us

  • Damage caused by weather, animals, or third parties

Our liability is limited to the value of the service provided.

12. Governing Law

These Terms are governed by the laws of the State of Nevada.

13. Changes to Terms

Happy Santa reserves the right to update these Terms at any time. Updates become effective once posted.
